Chalo Social app (hereinafter referred to as "Chalo") once again specially reminds you (the user) that before registering as a user, please carefully read this "User Agreement" (hereinafter referred to as the "Agreement") to ensure that you fully understand each clause of this Agreement.
Please read carefully and choose to accept or not accept this Agreement. By agreeing to all the terms of this Agreement, you can start to register, log in, and use the services involved in this Agreement. Accepting this Agreement will be regarded as acceptance of this Agreement and agreement to be bound by all the terms of this Agreement.
This Agreement stipulates the rights and obligations between Chalo and the user regarding the "Chalo" software service (hereinafter referred to as the "Service"). "User" refers to an individual who registers, logs in, and uses this service. This Agreement may be updated by Chalo at any time. Once the updated Agreement terms are published, they will replace the original Agreement terms without further notice. After Chalo modifies the Agreement terms, if the user does not accept the modified terms, please immediately stop using the services provided by Chalo. The user's continued use of the services provided by Chalo will be regarded as acceptance of the modified Agreement.
Declaration: This End-User License Agreement ("Agreement") is between you and Chalo and governs the use of this APP. Installing and registering the Chalo APP means that you agree to be bound by this Agreement and understand that there is no tolerance for offensive content. If you do not agree to the terms and conditions of this Agreement, you have no right to use the Chalo APP.
1. Account Registration
1.1 Before using this service, users need to register a "Chalo" account. The "Chalo" account should be registered by binding a mobile phone number. Please use a mobile phone number that has not been bound to the "Meet Happiness" account. As well as a mobile phone number that has not been banned by Chalo according to this Agreement to register the "Chalo" account. Chalo may change the account registration and binding methods according to user needs or product needs, without the need to notify users separately.
1.2 "Chalo" is a mobile social product based on the user's current city. Registering means agreeing to authorize Chalo to disclose and use its geographical location information.
1.3 Given the account binding registration method of "Chalo", you agree that Chalo will automatically extract your mobile phone number and mobile device identification code and other information for registration at the time of registration.
1.4 When users register and use this service, Chalo needs to collect personal information that can identify the user's identity so that Chalo can contact the user when necessary, or provide a better user experience for the user. The information collected by Chalo includes but is not limited to the user's name, gender, date of birth, ID number, school situation, company situation, industry affiliation, city, frequently played games, frequently visited stores, personal signature, membership card number; Chalo agrees that the use of this information will be subject to the constraints of Article 3 on user personal privacy information protection.
2. Service Content
2.1 The specific content of this service is provided by Chalo according to the actual situation, including but not limited to authorizing users to use other accounts for instant messaging, adding friends, joining groups, following others, and posting updates. Chalo may change the services it provides, and the content of the services provided by Chalo may change at any time: users will receive notifications from Chalo about service changes.
2.2 The service providers of "Chalo" rental services have no labor or employment relationship with Chalo in law or fact. The service providers of "Chalo" rental services independently provide the scope of services through the Chalo platform (including but not limited to the content of services, service duration, and service location). Users independently choose service providers, and Chalo only provides information matching services between the two parties. It must comply with national laws and regulations.
3. User Personal Privacy Information Protection Agreement (See "Chalo Privacy Policy" for details)
3.1 During the process of registering an account or using this service, users may need to fill in some or submit some necessary information, such as identity information required by laws, regulations, and normative documents (hereinafter referred to as "laws and regulations"). If the information submitted by the user is incomplete or does not comply with the provisions of laws and regulations, the user may not be able to use this service or may be subject to restrictions during the use of this service.
3.2 Personal privacy information refers to information involving the user's personal identity or personal privacy, such as the user's real name, ID card, mobile phone number, mobile device identification code, IP address, user chat records, membership card number. Non-personal privacy information refers to the basic record information of the user's operation status and usage habits of this service, which is clearly and objectively reflected on the Chalo server, other ordinary information outside the scope of personal privacy information, and personal privacy information that the user agrees to make public.
3.3 Respecting the privacy of user personal privacy information is a consistent policy of Chalo. Chalo will take technical measures or other necessary measures to ensure the security of user personal privacy information collected in this service, to prevent the leakage, damage, or loss of user personal privacy information collected in this service. In the event of the possibility of the aforementioned circumstances, remedial measures will be taken in a timely manner.
3.4 Chalo will not disclose or reveal user personal privacy information to any third party without the user's consent. However, the following specific circumstances are exceptions:
3.4.1 Chalo discloses the user's personal privacy information according to the provisions of laws and regulations or the instructions of the competent authority;
3.4.2 Any personal information leakage resulting from the user informing others of their user password or sharing their registered account and password with others, or other personal privacy information leakage not caused by Chalo;
3.4.3 The user voluntarily discloses his or her personal privacy information to a third party;
3.4.4 The user and Chalo and its cooperating units have reached an agreement on the use and disclosure of user personal privacy information, and Chalo discloses user personal privacy information to the cooperating units;
3.4.5 Any personal privacy information leakage caused by hacker attacks, computer virus infections, and other force majeure events;
3.5 The user agrees that Chalo may use the user's personal privacy information in the following matters.
3.5.1 Chalo sends important notifications to users in a timely manner, such as software updates, changes to the terms of this Agreement;
3.5.2 Chalo conducts internal audits, data analysis, and research, etc., to improve Chalo's products, services, and communication with users;
3.5.3 In accordance with the provisions of this Agreement, Chalo manages, reviews user information, and takes measures;
3.5.4 Other matters stipulated by laws and regulations;
In addition to the above matters, Chalo will not apply user personal privacy information to any other purposes without the prior consent of the user.
3.6 Chalo attaches great importance to the protection of minors' personal privacy information. Chalo will rely on the personal information provided by the user to determine whether the user is a minor. Any minor under the age of 17 who registers an account or uses this service should obtain the written consent of his or her parent or legal guardian (hereinafter referred to as "guardian"). Except for the disclosure according to the provisions of laws and regulations and the instructions of the competent authorities, Chalo will not use or disclose to any third party the chat records and other personal privacy information of minors. Except for the exceptional circumstances stipulated in this Agreement, without the prior consent of the guardian, Chalo will not disclose the personal privacy information of minors to any third party.
3.7 The user confirms that his or her geographical location information is non-personal privacy information. The user's successful registration of the "Chalo" account is deemed to authorize Chalo to use the user's geographical location information. The user's geographical location information will be one of the user's public information, disclosed to other users by Chalo. If the user wishes to stop disclosing his or her geographical location information to other users, he or she can set the mobile phone privacy at any time.
3.8 In order to improve Chalo's technology and services and provide users with a better service experience, Chalo may collect, use, or provide non-personal privacy information of users to third parties on its own.
3.9 At the request of the management department, Shenzhen Dingdangzuan Network Technology Co., Ltd. will collect the user's mobile phone IMEI information after the user registers.
4. Chalo "User Behavior Standards"
4.1 In order to maintain the basic order of Chalo and promote the healthy development of the social environment, these regulations are specially formulated. These regulations apply to all Chalo social users.
4.2 Penalty Regulations
4.2.1 Serious violations (Class A) refer to behaviors involving violence, bloodshed, pornography, politics, danger, fraud, etc., which seriously endanger public safety and disrupt the order of the Chalo platform. Violating the following provisions in any interactive behavior constitutes a serious violation, including but not limited to:
4.2.1.1 It is strictly forbidden to make statements that are anti-party and anti-government, or to engage in behaviors that insult and slander the Party and the government, such as:
1) Violating the basic principles established by the Constitution;
2) Endangering national security, leaking state secrets, subverting state power, and undermining national unity;
3) Damaging the honor and interests of the country;
4) Distorting, uglifying, desecrating, and negating the deeds and spirit of heroic martyrs, and infringing upon the names, portraits, reputations, and honors of heroic martyrs in other ways such as insult and defamation;
5) Promoting terrorism, extremism, or inciting the implementation of terrorist and extremist activities;
6) Inciting ethnic hatred and discrimination, and undermining ethnic unity;
7) Undermining the national religious policy, promoting cults, and feudal superstitions;
8) Spreading rumors and disrupting economic and social order;
9) Disseminating obscene, pornographic, gambling, violent, murder, terrorist, or crime-inciting content;
10) Insulting or defaming others, infringing upon the reputation, privacy, and other legitimate rights and interests of others;
4.2.1.2 It is strictly forbidden to spread content with obscenity, pornography, and low taste in any form, including but not limited to:
1) It is strictly forbidden to display or hint at sensitive parts of the body with sexual characteristics in various ways;
a) Users' behavior of changing clothes and exposing sensitive parts of the body when the camera is not completely turned off during video interaction;
b) Users appear in video interactions with exposed sensitive parts of the body, such as the chest and genitals of boys and girls (including children).
2) It is strictly forbidden to spread any information with sexual behavior, sexual teasing, or sexual insult content; for example:
a) Spreading information that invades others' privacy, such as peeping,偷拍, and exposure;
b) Spreading harmful information such as prostitution, one-night stands, wife swapping, and sexual abuse;
c) Spreading pornographic games and anime;
d) Spreading pornographic websites;
e) Spreading pornographic, teasing, and pornographic pictures, words, songs, texts, videos, voices, and other content;
f) Engaging in pornographic video conversations and sending pornographic self-taken naked photos offline with others.
4.2.1.3 It is strictly forbidden to display firearms, controlled knives, and engage in high-risk interactions. For example:
a) Waving controlled knives, firearms, high-fidelity firearms, and other highly dangerous behaviors;
b) It is strictly forbidden to engage in behaviors that endanger the personal safety of others. Such as: beating others, threatening others with knives, etc.;
c) It is strictly forbidden to engage in behaviors that endanger one's own safety. Such as self-harm, suicide.
4.2.1.4 It is strictly forbidden to spread drugs. Such as displaying drug samples, guiding and spreading drug use or injection methods, explaining the drug manufacturing process, etc.
4.2.1.5 It is strictly forbidden to promote gambling information in any way.
4.2.1.6 It is strictly forbidden to promote pyramid schemes, deceive users into joining pyramid organizations, or organize pyramid schemes themselves.
4.2.1.7 It is strictly forbidden to engage in other types of political, pornographic, illegal, infringing, or life-threatening interactive behaviors.
4.2.1.8 It is strictly forbidden for minors to engage in any form of interactive behavior.
4.2.1.9 It is strictly forbidden to mislead the interactive object into rewarding gifts and other behaviors, fabricating untrue information about the platform, such as functional limitations, blocking limitations, level limitations, etc.
Once serious violations (Class A) are discovered, the account will be permanently frozen, and all rewards in the account and all related rewards obtained as a super inviter will be deducted. At the same time, the company will immediately report to the relevant management departments and follow the guidance of the management departments to take corresponding measures.
4.2.2 General violations (Class B) refer to violations of the following management regulations, other than serious violations, that have a relatively minor impact on disrupting social public order and the order of the Chalo platform.
4.2.2.1 Interaction content regulations:
1) It is strictly forbidden to set nicknames, greetings, greeting videos, voice signatures, text signatures, etc. with vulgar and teasing titles;
2) It is strictly forbidden to organize interactive content with the purpose of harassment and teasing;
3) It is strictly forbidden to spread lowb pictures, voices, texts, games, video information, or guide lowb interaction;
4) It is strictly forbidden to engage in interactive behaviors with sexual hints, such as:
a) Focusing the lens on sexually sensitive parts covered by clothing;
b) Performing actions that can cause sexual fantasies;
c) Using sex toys as interactive props;
d) Other lowb interactive content.
5) It is strictly forbidden to spread infringing information, such as: unauthorized films and television, other video websites, live broadcast platforms, TV stations' pictures and sports events, etc.;
6) It is strictly forbidden to publish false information and fraudulent content;
7) It is strictly forbidden to get drunk and act disorderly or sleep in the video interaction process;
8) It is strictly forbidden for users to disclose others' information or infringe upon others' right to privacy in any way;
9) It is strictly forbidden for users to insult each other during the interaction. If it is not found at the time, it will also be traced and dealt with later;
10) It is strictly forbidden for users to engage in any form of interaction while in the driver's seat.
4.2.2.2 Dress and makeup regulations during video interaction:
1) It is strictly forbidden to wear only underwear, lingerie, or similar tight shorts;
2) It is strictly forbidden to deliberately expose sensitive parts such as cleavage and buttocks;
3) It is strictly forbidden to wear provocative lingerie, revealing clothes, sheer clothes, flesh-colored tight clothes, and lingerie worn outside;
4) It is strictly forbidden to wear other revealing clothes with obvious sexual hints and indecent dressing;
5) It is strictly forbidden to have vulgar, indecent, or unsettling makeup;
6) During video interaction, large areas of tattoos must not be exposed. For example, "flower arms" must be covered with long-sleeved clothes;
7) It is strictly forbidden to wear uniforms of national organs of the People's Republic of China (including Hong Kong, Macao, and Taiwan) during video interaction. Including police uniforms, military uniforms, business administration uniforms, procuratorate uniforms, court uniforms, urban management uniforms, road administration uniforms, etc.
4.2.2.3 Interaction speech regulations:
1) It is strictly forbidden to deliberately imitate various voices with sexual teasing;
2) It is strictly forbidden to deliberately make vulgar and pornographic remarks and guide users to engage in lowb interaction;
3) It is strictly forbidden to continuously curse, insult, and attack others, or to spread others' privacy;
4) It is strictly forbidden to promote other voice and video platforms in any form such as text, voice, and pictures.
Once general violations (Class B) are discovered, the company will take measures such as severe warnings, account suspension for a certain period, or even permanent account suspension, depending on the severity of the situation and social impact. At the same time, the company will keep regulatory records and file them with the relevant management departments. Penalties will be given according to the number of violations.
4.2.3 Minor violations (Class C) refer to violations that have a relatively minor impact on disrupting the order of the Chalo platform, other than serious and general violations.
4.2.3.1 It is strictly forbidden to leave the camera for a long time during video interaction, block the camera, or have dim lighting that fails to fully display personal facial features, resulting in an off-camera state lasting more than 1 minute.
4.2.3.2 It is strictly forbidden to publish and spread content with harassing, false, or transactional nature in any form (such as nicknames, greetings, ringtones, videos, etc.) or advertising content without the consent of Chalo.
4.2.3.3 It is strictly forbidden to publish information about borrowing money from others, asking for passwords, or other information involving property.
4.2.3.4 It is strictly forbidden to publish information about buying and selling accounts.
4.2.3.5 It is strictly forbidden to smoke or drink during video interaction.
4.2.3.6 It is strictly forbidden to harass the normal life of surrounding residents during video interaction and cause complaints from others.
Once general violations (Class C) are discovered, the company will give warnings, severe warnings, account suspension for a certain period, and at the same time, keep regulatory records and file them with the relevant management departments. Penalties will be given according to the number of violations.
Note: Chalo will update these management regulations at any time according to the development of the platform and in combination with relevant laws, regulations, policies, and instructions from regulatory authorities. This system shall take effect from the date of issuance.
5. Content Standards
5.1 The content referred to in this article means any content created, uploaded, copied, published, and disseminated by users during the use of this service, including but not limited to account avatars, names, personal signatures, and other registration information and certification information, or text, voice, pictures, graphics, and other messages sent and replied, as well as related link pages, and other content generated by using accounts or this service.
5.2 Users must not use the "Chalo" account or this service to create, upload, copy, publish, and disseminate the following content prohibited by laws and regulations:
5.2.1 Opposing the basic principles established by the Constitution;
5.2.2 Endangering national security, leaking state secrets, subverting state power, and undermining national unity;
5.2.3 Damaging the honor and interests of the country;
5.2.4 Inciting ethnic hatred and discrimination, and undermining ethnic unity;
5.2.5 Undermining the national religious policy and promoting cults and feudal superstitions;
5.2.6 Spreading rumors and disrupting social order and stability;
5.2.7 Disseminating obscene, pornographic, gambling, violent, murder, terrorist, or crime-inciting content;
5.2.8 Insulting or defaming others and infringing upon the legitimate rights and interests of others;
5.2.9 Content containing other information prohibited by laws and administrative regulations;
5.3 Users must not use the "Chalo" account or this service to create, upload, copy, publish, and disseminate the following content that interferes with the normal operation of "Chalo" and infringes upon the rights and interests of other users or third-party cooperation:
5.3.1 Containing any sexual hints;
5.3.2 Containing content with insults, threats, and intimidation;
5.3.3 Containing harassing, junk advertising, malicious information, and fraudulent information;
5.3.4 Involving others' privacy, personal information, or data;
5.3.5 Infringing upon others' rights to reputation, portrait, intellectual property, trade secrets, and other legitimate rights;
5.3.6 Containing other content that interferes with the normal operation of this service and infringes upon the rights and interests of other users or third parties;
6. Usage Rules
6.1 Any content transmitted or published by users in this service or through this service does not reflect or represent, nor shall it be deemed to reflect or represent, the views, positions, or policies of Chalo. Chalo assumes no responsibility for this.
6.2 Users must not use the "Chalo" account or this service to engage in the following behaviors:
6.2.1 Submitting and publishing false information, or stealing others' avatars or information, impersonating, and using others' names;
6.2.2 Forcing or inducing other users to follow, click on links, or share information;
6.2.3 Fabricating facts and concealing the truth to mislead and deceive others;
6.2.4 Using technical means to create a large number of fake accounts in bulk;
6.2.5 Using the "Chalo" account or this service to engage in any criminal activities;
6.2.6 Creating, publishing methods, tools related to the above behaviors, or operating and disseminating such methods and tools, whether for commercial purposes or not;
6.2.7 Using platform channels for illegal transactions, pornographic transactions, and other behaviors;
6.2.8 Other behaviors that violate laws and regulations, infringe upon the legitimate rights and interests of other users, interfere with the normal operation of "Chalo," or are not explicitly authorized by Chalo: Once verified, we have the right to unilaterally terminate the user's continued use of the account, permanently ban the account, and freeze the account funds. Chalo assumes no responsibility for such user behavior and will cooperate with relevant units and departments for verification and investigation.
6.3 Users shall be fully responsible for the authenticity, legality, harmlessness, accuracy, and effectiveness of the information transmitted through the "Chalo" account or this service. Any legal liability related to the information disseminated by the user shall be borne by the user himself/herself, and has nothing to do with Chalo. If this causes damage to Chalo or a third party, the user shall compensate according to law.
6.4 The services provided by Chalo may include advertisements. Users agree to be responsible for any transactions made during the use of the service based on the advertisements. For any losses or damages suffered by the user due to the advertisements, Chalo assumes no responsibility, except as explicitly provided by laws and regulations.
6.5 Under this agreement, any notices from Chalo to the user may be given through web page announcements, email, mobile text messages, or regular mail, etc. Such notices shall be deemed to have been delivered to the recipient on the date of dispatch. If there are any objections, they should be raised to Chalo within 1 day. Failure to provide feedback within the above time limit shall be deemed as the user having read and accepted it.
6.6 Users shall deliver notices to Chalo through the contact information officially published by Chalo, such as the communication address, fax number, email address, etc.
7. Account Management
7.1 The ownership of the "Chalo" account belongs to Chalo. After the user completes the application registration process, the user obtains the right to use the "Chalo" account. The right to use is granted to the initial applicant. The account is prohibited from being gifted, borrowed, rented, transferred, or sold. Chalo has the right to reclaim the user's "Chalo" account for business needs.
7.2 Users can change, delete personal information, registration information, and transmitted content on the "Chalo" account. However, it should be noted that deleting relevant information will also delete the text and pictures stored by the user in the system. The user must bear the risk.
7.3 Users have the responsibility to properly keep their registered account information and account passwords safe. If the user fails to keep them safe properly, it may lead to account theft or password loss, and the responsibility shall be borne by the user himself/herself. The user must assume legal liability for the actions taken under the registered account and password. The user agrees not to use other users' accounts or passwords under any circumstances. If the user suspects that someone else is using his/her account or password, the user agrees to immediately notify Chalo.
7.4 Users must comply with all the terms of this agreement and use this service correctly and properly. If the user violates any of the terms of this agreement, Chalo has the right to interrupt or terminate the provision of services to the breaching user's "Chalo" account after notifying the user. At the same time, Chalo reserves the right to reclaim the "Chalo" account at any time.
7.5 If the user does not log in to the "Chalo" account for many years, after notifying the user, Chalo can reclaim the account to avoid wasting resources. The adverse consequences caused by this shall be borne by the user himself/herself.
7.6 If there is any account suspected of abnormal capital transactions, Chalo has the right to freeze the relevant accounts first to ensure the safety of user funds.
8. Data Storage
8.1 Chalo is not responsible for the deletion or storage failure of any data related to the user in this service.
8.2 Chalo may decide on its own the longest storage period for user data in this service and allocate the maximum storage space on the server for the user. Users should back up relevant data in this service according to their own needs.
8.3 If the user stops using this service or this service is terminated, Chalo has the right to permanently delete the user's data from the server. After the termination of this service, Chalo has no obligation to return any data to the user.
8.4 If the "Chalo" account is canceled, Chalo will retain some of the user's information to ensure the integrity of information interaction with other users on the platform, without disclosing the user's information.
9. Risk Undertaking
9.1 The user understands and agrees that "Chalo" only provides a platform for users to share, transmit, and obtain information. The user must be responsible for all actions under his/her registered account, including any content transmitted by the user and any consequences arising therefrom. The user shall make his/her own judgment on the content in "Chalo" and this service and bear all risks arising from the use of the content, including the risks arising from reliance on the correctness, completeness, or practicality of the content. Chalo cannot and will not be responsible for any losses or damages caused by the user's actions. If the user finds anyone violating the terms of this agreement or using this service in other improper ways, please report or complain to Chalo immediately. Chalo will handle it in accordance with the terms of this agreement.
9.2 The user understands and agrees that, due to business development needs, Chalo reserves the right to change, suspend, terminate, or revoke all or part of the service content unilaterally. The user must bear this risk.
10. Intellectual Property Rights Declaration
10.1 Except for the intellectual property rights of the advertisements involved in this service, which are owned by the respective advertisers, the intellectual property rights of all the content provided by Chalo in this service (including but not limited to web pages, text, pictures, audio, video, charts, etc.) are owned by Chalo, except for the content published by the user himself/herself, which has obtained intellectual property rights in accordance with the law before using this service.
10.2 Except as otherwise expressly stated, the copyright, patents, and other intellectual property rights of the software relied upon by Chalo to provide this service are owned by Chalo.
10.3 The graphics, text, or compositions involved in this service of Chalo, as well as other Chalo logos and product and service names (hereinafter collectively referred to as "Chalo logos"), are owned by Chalo in terms of copyright or trademark rights. Without the prior written consent of Chalo, the user shall not display or use the Chalo logos in any way or otherwise deal with them, nor shall the user indicate to others that the user has the right to display, use, or otherwise deal with the Chalo logos.
10.4 The above and all other intellectual property rights owned by Chalo or related advertisers in accordance with the law are protected by law. Without the written permission of Chalo or related advertisers, the user shall not use them in any form or create any derivative works.
10.5 The copyright of the audio and video content generated by the user through the video live broadcast technical services provided by Chalo belongs to Chalo. The user enjoys the performer's rights based on his/her performance. Chalo respects and protects the intellectual property rights of users and can protect the rights for users when obtaining the user's authorization.
10.6 For any content uploaded by the user to the Chalo website through Chalo services (including but not limited to chat, photo album, dynamic updates) in publicly accessible areas, the user agrees that Chalo has the right and license to use, reproduce, modify, adapt, publish, translate, create derivative works, disseminate, perform, and display such content (in whole or in part) and/or to incorporate such content into other works, media, or technologies currently known or later developed worldwide, free of charge, perpetual, irrevocable, non-exclusive, and fully sublicensable.
11. Legal Liability
11.1 If Chalo finds or receives reports or complaints from others that the user has violated the terms of this agreement, Chalo has the right to review and delete relevant content at any time without notice, including but not limited to user information and chat records. Penalties such as warnings, account bans, device bans, functional bans, and account fund freezes may be imposed on the violating account, and the user will be notified of the handling results.
11.2 The user understands and agrees that Chalo has the right to impose penalties for behaviors that violate relevant laws and regulations or the terms of this agreement, take appropriate legal actions against any user who violates laws and regulations, and preserve relevant information and report to the relevant departments in accordance with laws and regulations. The user shall bear all legal liabilities arising therefrom.
11.3 The user understands and agrees that if the user violates this agreement, resulting in or causing any claims, demands, or losses from any third party, including reasonable attorney's fees, the user shall compensate Chalo and its cooperating companies and related companies and hold them harmless.
12. Force Majeure and Other Exemptions
12.1 The user understands and confirms that during the use of this service, there may be risks of force majeure that may interrupt this service. Force majeure refers to objective events that cannot be foreseen, overcome, or avoided and have a significant impact on one or both parties, including but not limited to natural disasters such as floods, earthquakes, plagues, and storms, as well as social events such as wars, riots, and government actions. When such situations occur, Chalo will cooperate with relevant units to repair it in the first place. However, for any losses caused to the user or a third party, Chalo and its cooperating units are exempt from liability within the scope permitted by law.
12.2 This service, like most Internet services, is subject to various security issues, including but not limited to user reasons, network service quality, and social environment differences, which may be subject to various security threats. For example, others may use the user's information to cause harassment in real life. Other software downloaded and installed by the user or other websites visited may contain "Trojan horses" and other viruses, threatening the security of the user's computer information and data, and in turn affecting the normal use of this service. Users should enhance their awareness of information security and protection of user information and pay attention to strengthening password protection to avoid losses and harassment.
12.3 The user understands and confirms that this service may be subject to risks of service interruption or failure to meet user requirements due to reasons such as force majeure, computer viruses or hacker attacks, system instability, user location, user shutdown, and other technical, Internet, and communication line reasons. Therefore, any losses caused to the user or a third party, Chalo assumes no responsibility.
12.4 The user understands and confirms that there may be information from any other person in the use of this service, including misleading, deceptive, threatening, defamatory, objectionable, or illegal information, or anonymous or pseudonymous information that infringes upon the rights of others, as well as behaviors accompanying such information. Therefore, any losses caused to the user or a third party, Chalo assumes no responsibility.
12.5 The user understands and confirms that Chalo needs to regularly or irregularly maintain or maintain the "Chalo" platform or related equipment. If this causes service interruption within a reasonable time, Chalo assumes no responsibility. However, Chalo should give prior notice.
12.6 Chalo's right to handle illegal, regulatory, or breach of contract content in accordance with laws and regulations and the terms of this agreement does not constitute an obligation or commitment of Chalo. Chalo cannot guarantee the timely discovery of illegal, regulatory, or breach of contract behavior or take corresponding measures.
12.7 The user understands and confirms that for the quality defects of the following products or services provided by Chalo to the user and any losses caused thereby, Chalo assumes no responsibility.
12.8 Under no circumstances will Chalo be liable for any indirect, consequential, punitive, incidental, special, or exemplary damages, including but not limited to lost profits suffered by the user due to the use of "Chalo" or this service (even if Chalo has been informed of the possibility of such losses). Despite any contrary provisions in this agreement, the total liability of Chalo to the user for any reason or in any manner shall not exceed the amount paid by the user to Chalo for the use of the services provided by Chalo (if any).
13. Changes, Interruptions, and Termination of Service
13.1 Given the particularity of network services, the user agrees that Chalo has the right to change, interrupt, or terminate all or part of the service (including paid services) at any time. If Chalo changes, interrupts, or terminates the service, Chalo shall notify the user in advance and provide equivalent alternative services to the affected users.
13.2 If any of the following circumstances occur, Chalo has the right to change, interrupt, or terminate the free or paid services provided to the user without assuming any responsibility to the user or any third party:
13.2.1 According to the law, the user should submit true information, but the personal information provided by the user is not true, or it is inconsistent with the information registered at the time of registration and no reasonable proof can be provided;
13.2.2 The user violates relevant laws and regulations or the terms of this agreement;
13.2.3 In accordance with the law or the requirements of the competent authorities;
13.2.4 For security reasons or other necessary circumstances.
14. Others
14.1 Chalo solemnly reminds users to pay attention to the terms in this agreement that exempt Chalo from liability and restrict users' rights. Please read carefully and consider the risks independently. Minors should read this agreement accompanied by their legal guardians.
14.2 The validity, interpretation, and resolution of disputes of this agreement are governed by the laws of the People's Republic of China. If any dispute or controversy arises between the user and Chalo, it should first be resolved through friendly consultation. If no agreement can be reached through consultation, the user agrees to submit the dispute or controversy to the people's court with jurisdiction over the domicile of Chalo.
14.3 If any term of this agreement is invalid or unenforceable for any reason, the remaining terms shall still be valid and binding on both parties.
15. Child Safety Policy
15. Child Safety Policy Chalo has a zero-tolerance approach to any acts of abuse, exploitation and/or sexualization involving children. Any users not upholding Chalo’s policies for protecting minors (anyone under the age of 18) as outlined below face removal from Chalo and potential actions by law enforcement.
15.1 Policies
15.1.1 Age Restriction You must be 18 years of age or older to use Chalo. Any attempts to falsify age to access the platform are strictly prohibited and will result in account suspension or removal.
15.1.2 Chalo uses automated and manual systems to detect underage activity as well as Child Sexual Exploitation and Abuse ("CSEA"). Any attempt to circumvent these systems is prohibited. Prohibited Activities include but are not limited to actions such as:
15.1.3 Sexualization of Minors and CSAE (Child Sexual Abuse and Exploitation) Sharing, creating, or distributing content involving child sexual abuse or exploitation. Content involving the sexual fetishization of minors, such as discussions, sexualized playacting, or wearing sexualized clothing, is prohibited. Depictions of child nudity or sexualization in any form, including artistic representations such as drawings or animations.
15.1.4 Harmful or Dangerous Acts Involving Minors Threats, encouragement, or acts of physical violence against minors. Psychological abuse, coercion, or manipulation of minors. Depicting or encouraging dangerous activities involving minors. Promoting or depicting neglect or trafficking of minors.
15.1.5 Underage Appearance on the Platform Underage appearing in live streams, videos, or any other form of content is strictly prohibited. Creating or managing accounts on behalf of minors. Attempts to falsify age to gain access to the platform.
15.1.6 Reporting Mechanism Incidents involving minor abuse will be reported to relevant authorities as required by applicable law. Users can report potential violations using the in-app reporting function or by contacting us at Chalocs@Chalo.chat
15.1.7 Prohibited Users Users convicted of crimes against children, including but not limited to sexual assault, physical abuse, neglect, or trafficking, are strictly prohibited from using Chalo.
15.2 Execution and Transparency
15.2.1 Enforcement Measures All violations of the Child Safety Policy will result in immediate account penalty. Depending on the severity of the violation, Chalo may cooperate with law enforcement agencies for investigations.
15.2.2 User Education We educate users on child safety through: Child Safety Policy on our platform. Prompts and reminders during content creation and sharing to avoid risky situations.
15.2.3 Commitment to Child Safety Chalo continuously evaluates and improves its policies, systems, and practices to uphold the highest standards of child safety. We aim to make our platform a safe and inclusive space for everyone. Article 13 [Law Application, Jurisdiction and Others] The conclusion, entry into force, interpretation, amendment, supplementation, termination, execution and dispute resolution of this agreement shall be governed by the laws of the Republic of Singapore, without regard to the principle of legal selection; if there are no relevant provisions in the law, refer to business practices and/or industry practices. Disputes arising from using the Chalo service and related to the Chalo service will be resolved by the Chalo operator in consultation with you. When the negotiation fails, either party shall submit to the Singapore International Arbitration Centre (SIAC), and the arbitration shall be conducted by it in accordance with the Singapore International Arbitration Centre (SIAC)'s arbitration rules. The place of arbitration shall be Singapore, and the language of arbitration shall be English. If any clause of this agreement is deemed to be repealed, invalid or unenforceable, the clause shall be regarded as divisible and shall not affect the validity and enforceability of the remaining clauses of this agreement.
